Terms of Service

You must be at least 18 years old to use CKURO.ART. By creating an account, you confirm that you meet this requirement. We reserve the right to terminate accounts that we reasonably believe belong to minors.

Accounts are created via Google or GitHub OAuth, managed by Clerk. You are responsible for maintaining the security of your account and for all activity that occurs under it. You may not share your account or use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms.

Your account begins with guest status. To purchase art, your account is upgraded to buyer. To sell art, you must apply and be approved as an artist.

By submitting artwork, artists certify that every piece was created by a human — themselves — without the use of AI image generators, AI audio generators, or other generative AI tools as the primary creative instrument. This includes but is not limited to: Midjourney, Stable Diffusion, DALL·E, Suno, Udio, and equivalent tools.

Use of AI tools for minor post-processing (e.g. background removal, noise reduction) on otherwise human-created work may be acceptable at our discretion. If in doubt, disclose it in your application or artwork description.

Submitting AI-generated content as human-made work will result in immediate and permanent removal from the platform.

CKURO.ART includes a community forum and blog comment system. By participating, you agree not to post content that is abusive, harassing, defamatory, spam, off-topic, or otherwise harmful to the community. We reserve the right to remove posts or ban users who violate community standards at our sole discretion.

You may not use CKURO.ART to:

• ▸Violate any applicable local, national, or international law or regulation.
• ▸Infringe on the intellectual property rights of any third party.
• ▸Submit AI-generated content as human-created work.
• ▸Attempt to circumvent our moderation or verification systems.
• ▸Conduct unauthorized scraping, crawling, or automated access of the platform.
• ▸Harass, abuse, or threaten other users.
• ▸Impersonate another person or entity.
• ▸Upload malware or malicious code of any kind.
• ▸Engage in fraudulent activity including fake purchases or chargebacks.

We may suspend or terminate your account at any time for violation of these Terms, or for any other reason at our discretion, with or without notice. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination — including intellectual property provisions, disclaimers, and limitations of liability — will survive.

CKURO.ART is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, CKURO.ART shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

We may revise these Terms at any time. When we do, we will update the "Last updated" date above. If changes are material, we may notify you by email. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
